Le imprese che hanno ricevuto Aiuti di Stato e Aiuti de Minimis, soggetti all’obbligo di pubblicazione nel Registro Nazionale degli Aiuti di Stato (RNA) – Sezione Trasparenza, possono adempiere agli obblighi di pubblicità e trasparenza indicando sul proprio sito internet aziendale – o in assenza di tale soluzione su quello della propria Associazione di Categoria – l’esistenza di tali aiuti con un’autodichiarazione, senza la necessità di pubblicare il prospetto dettagliato dei contributi ricevuti. In caso di inosservanza dell'obbligo di trasparenza, è prevista una sanzione amministrativa pecuniaria pari all’1% degli importi ricevuti, con un importo minimo di 2.000€, oltreché una sanzione accessoria dell’adempimento della pubblicazione. Qualora il trasgressore non proceda alla pubblicazione e al pagamento della sanzione pecuniaria entro 90 giorni dalla contestazione, scatterà la sanzione aggiuntiva che consiste nella restituzione integrale dei contributi e degli aiuti ricevuti.
